ROADWORKS BEGIN, IMMEDIATELY BECOME PERMANENT

Orange Cones Achieve Tenancy Rights After Eighteen Months Continuous Occupation

HELDERBERG — Legal experts in the Somerset West area are examining what could become a landmark case in property law after a set of orange roadwork cones placed at a road construction site in early 2023 appear to have achieved, through continuous uninterrupted occupation, a form of tenancy that may complicate their removal.

The roadworks, announced with the usual municipal fanfare and illustrated boards showing what the completed improvement would look like in an artist’s impression where the road is inexplicably empty of traffic, began promptly and with visible activity. A digger was present. Men in orange vests were present. For approximately three weeks there was genuine industry and residents who passed daily reported a cautious optimism of the kind that experience has taught the Helderberg to ration carefully.

Then the digger left.

The men in orange vests left.

The cones stayed.

The cones have been there through two rainy seasons, one municipal election, the complete renovation of Mike’s Mugs two streets away and the ongoing pothole situation in Gordon’s Bay with which they have developed what observers are calling “a solidarity.” They have settled. They have become contextual. New residents who moved to the area in 2024 are unaware that the cones are temporary infrastructure and have incorporated them into their mental map of the road as permanent features.

One Somerset West woman has been using the cones as a landmark for directing visitors for so long that she cannot now describe the route without them. “Turn left at the cones” has appeared in her directions to the house at least forty times. If the cones are removed she will need to recalibrate entirely and is not sure she has the emotional bandwidth.

The municipality confirmed that the roadworks were “in progress” which is technically true in the sense that time has continued to pass since they began. A completion date was not available. The cones were not available for comment but their continued presence communicates a confidence that no completion date could match.
